Welcome to Sagarmatha Seeds (hereinafter referred to as “the Seller”, “we”, “us”, or “our”). These Terms and Conditions apply to all offers, orders, and agreements made through our website highestseeds.com. By accessing our website and/or placing an order, you agree to be bound by these terms.

1. Minimum Age and Access

  • Age Restriction: Access to this website and the sale of our products is strictly limited to individuals who are 18 years of age or older (or 21 years of age or older depending on the legal age in your jurisdiction).
  • Verification: By entering the website and during the checkout process, the Buyer truthfully declares that they have reached the legal minimum age.
  • Cancellation: If we suspect that the Buyer is a minor, we reserve the right to cancel the order immediately without notice.

2. Legal Status and Buyer Responsibility

  • Souvenir and Collector Status: All cannabis seeds are sold strictly as souvenirs, collectables, or for genetic preservation purposes
  • Cultivation Prohibited: In many countries, germinating and cultivating cannabis seeds is illegal. We do not sell seeds to anyone whom we suspect intends to use them for illegal cultivation. We do not provide cultivation instructions or germination advice.
  • Local Legislation: The legal status of cannabis seeds varies significantly by country and region. The Buyer is solely and fully responsible for checking and complying with all local laws regarding the import, possession, and use of these products.
  • Indemnification: Sagarmatha accepts no liability for products seized by customs or for any legal consequences incurred by the Buyer due to the violation of local laws.

3. Orders and Order Limits

  • Purchase Limits: To prevent abuse and large-scale illegal distribution, we may enforce maximum limits per order (e.g., a maximum of 25 seeds or €250 per customer per day).
  • Refusal of Orders: We reserve the right to refuse or cancel any order at our sole discretion, without providing a reason.

4. Pricing and Payment

  • Currency and VAT: All prices listed are in Euros (€) (or local currency) and include statutory VAT unless stated otherwise.
  • Price Modifications: Prices are subject to change at any time without prior notice.
  • Payment Methods: We accept the payment methods indicated on our website (e.g., bank transfer, cryptocurrency, or cash by mail at the Buyer’s own risk). Orders will only be processed after full payment is received.

5. Shipping and Delivery

  • Dispatch Timeline: Accepted orders will be dispatched as quickly as possible, and no later than e.g., 14 days from payment confirmation.
  • Delays: If a product is temporarily out of stock, the Buyer will be notified. In case of prolonged delays, the Buyer has the right to cancel the order free of charge.
  • Stealth Shipping: To ensure privacy, all seeds are shipped in discrete, neutral packaging with no reference to cannabis or the shop name on the outside.

6. Right of Withdrawal (Returns and Refunds)

  • Cooling-off Period: Consumers within the EU have a legal right to a 14-day cooling-off period after receiving the product.
  • Exclusion (Sealed Packaging): Due to the nature and fragility of the product, cannabis seeds can only be returned if the original, sealed breeder packaging remains completely unopened and undamaged. Opened, damaged, or germinated seeds are strictly excluded from returns and hold no residual value.
  • Return Costs: The costs of the return shipment are borne entirely by the Buyer, unless the product was delivered defective or incorrectly.

7. Exclusion of Warranty and Liability

  • No Germination Guarantee: Because seeds are sold exclusively as souvenirs and genetics are a natural product, we provide no warranty or guarantee regarding germination rates, yield, sex (feminization), or final THC/CBD levels of the plants.
  • Limitation of Liability: The total liability of Sagarmatha is at all times limited to the purchase price of the specific products ordered. We are not liable for indirect damages, lost profits, or legal claims.

8. Governing Law and Jurisdiction

  • Applicable Law: These terms and conditions and all agreements shall be governed exclusively by the laws of The Netherlands
  • Disputes: Any disputes will be submitted in the first instance to the competent court in the district where the Seller’s business is registered.
